In 2005, 14 percent of train accidents on mainline track caused by human error involved the improper handling or misuse of the automatic braking system. Today’s air-brake systems are built on 19th century pneumatic technology that has been progressively refined to support current railroad operations. Broad agreement exists among railroads, suppliers, and users of these systems that they have serious limitations that cannot be remedied with further incremental changes.

In 2006, FRA released the Booz Allen Hamilton final report, “ECP Brake System for Freight Service.” The study addresses the issues surrounding this technology, presents alternative plans for ECP brake implementation, and offers a recommended approach.

On October 16, 2008, the FRA amended Title 49 Code of Federal Regulations Part 232, Brake System Safety Standards for Freight and Other Non-Passenger Trains and Equipment, by publishing new regulations (see Federal Register Vol. 73, No 201) that address the maintenance and operation requirements for ECP brake systems. The final rule became effective January 12, 2009.
