Charlotte NC Locomotive and Railcar Maintenance Facility Fire Alarm System Components Waiver Request

Summary

Lake Electric Co., the electrical construction contractor for the Locomotive and Railcar Maintenance Facility (Facility Project) in Charlotte, NC, has requested a non-availability waiver from the Federal Railroad Administration (FRA) regarding the Buy America requirements contained in 49 U.S.C. 24405(a). The request pertains to components of the fire alarm system for the Facility Project, sponsored by the North Carolina Department of Transportation. The foreign components total less than $4,000. Lake Electric contends that these components are not available from a U.S. source. The total cost of the entire project is $23.25 million.

Before deciding whether to grant this waiver, and to assist FRA when analyzing this request, FRA is requesting public comments. A detailed justification for Lake Electric’s waiver request is available here.

FRA will consider all comments to this waiver request received in the initial 15-day comment period. Comments received after the initial 15-day comment period will be considered to the extent practical.

Granting of a waiver of the Buy America Act in USC 49, cite omitted, flies in the face of Congressional intent expressed in the "America Recover & Reinvestment ACT of 2009. Granting a waiver to facilitate this modest purchase will open the door and create a wide avenue of opportunity for revisiting and reconsideration of the CRRC waiver, which has already been ruled on, and received denial of funding for participation with X-Press West, in developing the future high speed rail corridor from Los Angles to Las Vegas. The waiver request here should therefore be denied as well.
