Section 106 Program Comment to Exempt Consideration of Effects to Rail Properties Within Rail Rights-of-Way Webinar

On August 17, 2018, the Advisory Council on Historic Preservation approved the final Program Comment to Exempt Consideration of Effects to Rail Properties within Rail Rights-of-Way. The Program Comment was a requirement of Section 11504 of the Fixing America’s Surface Transportation (FAST) Act, and it provides federal agencies, including FRA, a way to improve the timeliness and effectiveness of rail project reviews under Section 106 of the National Historic Preservation Act. The Program Comment establishes two methods to achieve this: an activities-based approach and a property-based approach. This webinar will focus on the activities-based approach which exempts from Section 106 review a variety of maintenance, repair, and upgrades to rail infrastructure that are necessary to ensure the safe and efficient operation of freight, intercity passenger, commuter rail, and rail transit operations.
